This document contains the jurisdiction entries for the Activity Travel Protocol Jurisdiction Compliance Registry. It is versioned independently from the Specification — regulatory changes update this document without requiring schema changes.

Each entry follows the structure defined in the Jurisdiction Compliance Registry Specification v0.2. All four primary jurisdictions are given equal treatment and consistent depth.

Regulatory Framework

Japan's travel industry is governed primarily by the Travel Agency Act (旅行業法), first enacted 1952, substantially revised 2018. The Act is administered by the Japan Tourism Agency (JTA) under MLIT. It establishes a tiered licensing system and defines which activities constitute regulated "travel agency business" (旅行業).

The Act predates AI-assisted booking, digital marketplaces, and the hotel-led activity packaging model. This gap creates several gray zones addressed by the sandbox flags in this entry.

JP Licensing Requirements


JP-LIC-001 — Travel Agency License: Package Sales

Any party selling a combination of transportation with accommodation or other services at an inclusive price to a customer must hold a Travel Agency License (旅行業登録).

Trigger: selling_roles = any; product_type = package_two_components or package_three_or_more where one component is transportation; customer_type = consumer or corporate; sale_jurisdiction = JP

Applies to roles: TOUR_OPERATOR, TRAVEL_AGENT, ONLINE_TRAVEL_AGENCY, and any party acting as primary seller of a qualifying package

JP-LIC-002 — Licensed Intermediary for Hotel Activity Packaging

A hotel or accommodation provider wishing to include off-premise activities in a package sold to guests must either hold a Class 3 or above Travel Agency License, or use a licensed intermediary in a split-seller (手配旅行) configuration.

Trigger: selling_roles = ACCOMMODATION_SUPPLIER; product_type = package_two_components where second component is an off-premise activity; sale_jurisdiction = JP

Applies to roles: ACCOMMODATION_SUPPLIER acting as package seller

JP-LIC-003 — Inbound Tour Operator

A party operating inbound tours for foreign visitors may require registration as an inbound tour operator depending on scope of services.

Trigger: selling_roles = TOUR_OPERATOR; customer_type = foreign visitor; consumption_jurisdiction = JP

Required credential: TRAVEL_AGENCY_LICENSE Class 1 or 2 for international scope, or INBOUND_TOUR_OPERATOR_REGISTRATION

JP-LIC-004 — Travel Agency Manager Qualification

Each licensed travel agency location must designate a qualified Travel Agency Manager (旅行業務取扱管理者) who has passed the national examination.

Applies to roles: TOUR_OPERATOR, TRAVEL_AGENT, ONLINE_TRAVEL_AGENCY

Required credential: TRAVEL_AGENCY_MANAGER_CERT (national exam pass certificate)

Activity Travel Protocol note: This credential applies to individuals (Actors), not the Party entity. It is declared as an Actor credential, not a Party credential.

JP Consumer Protection Requirements


JP-CP-001 — Compensation Insurance (損害賠償責任保険)

Licensed travel agents must maintain compensation insurance covering customer losses from errors or negligence in travel arrangement.

Protection type: liability_insurance

Trigger: whenever Travel Agency License is required

Applies to roles: TOUR_OPERATOR, TRAVEL_AGENT, ONLINE_TRAVEL_AGENCY

Minimum coverage by class:

  • Class 1: ¥1,000,000,000 (¥1 billion) aggregate annual
  • Class 2: ¥500,000,000 aggregate annual
  • Class 3: ¥100,000,000 aggregate annual

JP-CP-002 — Travel Business Bond (営業保証金)

Licensed Class 1 and Class 2 agents must deposit a business bond with JTBF (Japan Tourism Business Foundation) or maintain equivalent approved insurance. Protects customers if the agent becomes insolvent.

Protection type: bonding

Applies to roles: TOUR_OPERATOR (Class 1 and 2), TRAVEL_AGENT (Class 1 and 2)

Minimum bond:

  • Class 1: ¥7,000,000 base + ¥1,500,000 per branch
  • Class 2: ¥1,100,000 base

JP-CP-003 — Written Contract Requirement (書面交付義務)

All travel contracts above ¥10,000 must be accompanied by a written contract document issued to the customer.

Protection type: payment_protection

Trigger: transaction_value ≥ ¥10,000; customer_type = consumer

Applies to roles: TOUR_OPERATOR, TRAVEL_AGENT, ONLINE_TRAVEL_AGENCY

Activity Travel Protocol mapping: Fulfilled by the CONFIRMATION document generated at CONFIRMATION state. Document must include all fields required under JP-DISC-002.

JP Packaging Obligations


JP-PKG-001 — Organized Package Tour (募集型企画旅行)

A pre-planned package tour sold to customers constitutes 募集型企画旅行 and triggers full Travel Agency Act obligations.

Threshold: ≥2 component types including transportation; sold at inclusive price; pre-planned (not assembled in response to a specific customer request); any duration

Obligations triggered:

  • TRAVEL_AGENCY_LICENSE required
  • Written contract required (JP-CP-003)
  • Compensation insurance required (JP-CP-001)
  • Business bond required (JP-CP-002)
  • Pre-trip information required (JP-DISC-001)
  • Standard cancellation fee schedule applies (Article 16 schedule)

JP-PKG-002 — Custom-Arranged Package (受注型企画旅行)

A package assembled in response to a specific customer request. This is the primary product type Activity Travel Protocol is designed to enable — a customer initiates an INQUIRY, a configuration is assembled through Activity Travel Protocol's INQUIRY → CONFIGURATION → PROPOSAL flow, and the result is a 受注型企画旅行.

Threshold: Same components as JP-PKG-001 but assembled in direct response to customer INQUIRY rather than pre-planned

Obligations triggered: Same as JP-PKG-001

Activity Travel Protocol mapping: Activity Travel Protocol's full booking workflow from INQUIRY through CONFIRMATION is the technical implementation of the 受注型企画旅行 booking process.


JP-PKG-003 — Arranged Travel / Split-Seller (手配旅行)

Where each component is contracted separately by its direct provider with no single party selling an inclusive package, this is classified as 手配旅行. Package obligations do not apply. This is the legal basis for Activity Travel Protocol's split-seller configuration.

Threshold NOT triggered when:

  • Each service component contracted separately with its direct provider
  • No single party sells an inclusive or combined price
  • Customer enters separate contracts for each component

Consumer protection note: Full package protections do not apply in this configuration. Customer does not have a single contract covering the whole experience. Disclosure JP-DISC-003 is REQUIRED.


JP Disclosure Requirements


JP-DISC-001 — Pre-Contractual Information (契約前説明)

Written information covering all key terms must be provided before the contract is concluded.

JP-DISC-002 — Confirmation Document (契約書面)

Upon conclusion of the travel contract, the agent must issue a written confirmation.

JP-DISC-003 — Split-Seller Configuration Notice

When a transaction uses the split-seller configuration, the customer MUST be informed that they are entering separate contracts with each provider and do not have the protections of a package travel contract.

JP-DOM-FOOD-001 — Food Safety

JP-DOM-TRANSPORT-001 — Ground Transport

Governing authority: Municipal government (varies by resort location); MLIT guidelines

Required credentials:

  • SKI_SLOPE_SAFETY_INSPECTION — annual municipal inspection (Assurance Level 2)
  • SKI_PATROL_CERTIFICATION — qualified patrol required on all open slopes (Assurance Level 2)

Note: Nagano Prefecture has the most developed regulatory framework given its concentration of ski resorts. Requirements vary significantly by municipality.

JP-TRAVEL-LAW-SPLIT-SELLER

Flag name: Hotel Activity Packaging — Split-Seller Configuration
Category: licensing · Status: active

Regulatory context: Travel Agency Act Article 2 defines "travel agency business" broadly enough that a hotel facilitating activity bookings for its guests may be construed as conducting travel agency business without a license.

Ambiguity: JTA's 2019 guidance memo acknowledged the gray zone for hotels curating local activities but did not issue definitive clarification. Hotels operating this model in good faith face legal uncertainty.

Compliant path available: Yes — the 手配旅行 (arranged travel) configuration:

  1. Hotel contracts with guest for accommodation only (accommodation license sufficient)

Regulatory context: The Travel Agency Act does not address AI agents acting on behalf of consumers. Whether an AI agent initiating a booking constitutes conducting travel agency business is unaddressed in any JTA guidance.

Regulatory Framework

The EU travel industry is governed primarily by the Package Travel Directive (PTD) 2015/2302/EU, transposed into national law by each member state. The PTD provides comprehensive consumer protection for packages and introduces the concept of Linked Travel Arrangements (LTAs) — a lower-obligation category for digitally connected bookings that fall short of a full package.

The PTD applies when:

  • Two or more different types of travel service are combined for the same trip
  • From a single point of sale
  • At an inclusive or total price
  • For a period of more than 24 hours or including an overnight stay

Linked Travel Arrangements (LTAs) apply when a customer purchases additional travel services from a seller who has access to their payment details from a prior booking within 24 hours, or via a click-through link. LTAs require insolvency protection and disclosure but not the full PTD package obligations.

Member state variation: While the PTD is harmonized at minimum level, member states may exceed these protections. Germany (Reiserecht), France (Code du Tourisme), and Italy (Codice del Turismo) have significant additional requirements. This entry covers the EU-level baseline; member-state entries will be added in v0.2.

EU-LIC-002 — Linked Travel Arrangement Facilitator

Any party facilitating an LTA — providing a click-through to additional travel services or retaining payment details — must provide insolvency protection and disclosure, even if they do not qualify as a package organizer.

Trigger: Platform provides booking facilitation where customer purchases additional travel services within 24 hours of initial booking, using retained payment details or via targeted click-through

EU-LIC-003 — IATA Accreditation for Air Components

Any party selling air tickets as part of a package or independently must hold IATA accreditation or sell through an IATA-accredited agent.

EU Consumer Protection Requirements


EU-CP-001 — Package Insolvency Protection

Package organizers must provide insolvency protection covering 100% of customer payments plus repatriation costs if the organizer becomes insolvent.

Protection type: insolvency_protection

Trigger: product_type = package (meeting PTD definition); customer_type = consumer

Applies to roles: TOUR_OPERATOR, TRAVEL_AGENT acting as organizer

Minimum coverage: 100% of all payments made by or on behalf of travelers, plus repatriation cost for travelers already on their trip

Mechanism options: Insurance policy, bank guarantee, ring-fenced trust account, or approved industry guarantee fund (varies by member state)

EU-CP-002 — LTA Insolvency Protection

LTA facilitators must provide insolvency protection for the value of travel services they have facilitated.

Minimum coverage: Value of travel services for which the facilitator has received payment or through which payment was processed

EU-CP-003 — GDPR Compliance for Customer Data

All parties processing personal data of EU residents must comply with GDPR, including legal basis for processing, data subject rights, data retention limits, and breach notification.

EU Packaging Obligations


EU-PKG-001 — Package Travel Obligations

A combination meeting the PTD package definition triggers the full suite of package organizer obligations.

Threshold: 2+ types of travel services (transport, accommodation, car rental, or other tourist services); combined for the same trip; at inclusive/total price OR from single point of sale; duration > 24h or includes overnight stay

Obligations triggered:

  • Package organizer registration (EU-LIC-001)
  • Insolvency protection (EU-CP-001)
  • Pre-travel information (EU-DISC-001)
  • Confirmation document (EU-DISC-002)
  • Price revision: increases permitted only above 8% of package price with right to cancel without penalty
  • Right of transfer: customer may transfer booking to another person with reasonable notice
  • Significant alteration rights: customer may cancel without penalty if organizer makes significant changes
  • Termination rights: customer may cancel for unavoidable extraordinary circumstances at destination
  • Organizer liable for all services in the package (even those provided by third parties)

Regulatory Framework

Regulatory Framework

The United States has no federal travel agency licensing law. Regulation is primarily at the state level through Seller of Travel (SOT) statutes. California's regime is the most comprehensive and most relevant because of its extraterritorial reach — it applies to any seller offering travel services to California residents regardless of where the seller is located.

Federal-level consumer protection is provided by:

US Packaging Obligations

While there is no statute, FTC enforcement has established that:
